Claimant hurt while working as a home health aide in December 15, 2011 slipped and fell down multiple stairs injuring her back, neck, and left leg. We met with the claimant, discussed her case and she asked us to represent her in her Workers’ Compensation case.
We filed the proper paperwork with the New York State Workers’ Compensation Board immediately on December 19, 2011 in order to protect he claimant’s rights. On January 27, 2012 the employer controverted the claim denying the accident due to insufficient notice. A trial was then held on June 28, 2012 where claimant credibly testified that she had a slip and fall down stairs causing injury to back, neck and left leg. Additionally, claimant testified that she was taken via ambulance to the hospital and provided notice to her coordinator the day after the accident.
The employer fought hard, but we were ultimately successful and the judge found the claimant to be credible establishing her claim on August 9, 2012.
But that was not all. The employer in claimant’s case appealed the decision arguing that the Workers’ Compensation Law judge erred in establishing the claim. We take pride in ensuring that every claimant who has had an injury is compensated for the injury they sustained when they were at work and contributing to our community. With this ideology our office did not give up on our fight against this employer and we can report that on October 03, 2013 we won the appeal. The claimant called on October 25, 2013 to express her gratitude for never giving up as she finally received her Workers’ Compensation check.
